Ozekhome: Court Adjourns Arraignment, As AGF takes over ICPC's Fraud Prosecution Case

Ozekhome: Court Adjourns Arraignment, As AGF takes over ICPC's Fraud Prosecution Case

The Federal Capital Territory, FCT, High Court sitting in Abuja, on Monday, granted the Attorney-General of the Federation and Minister of Justice, AGF Lateef Fagbemi, SAN, approval to review the fraud charges filed by the Independent Corrupt Practices and Other Related Offences Commission, ICPC,  against a constitutional lawyer, Chief Mike Ozekhome, SAN.

The court then, adjourned the Ozekhome’s arraignment, earlier scheduled for Monday, to February 24, 2026, to allow the AGF’s office study the case file.
At the proceedings, the Director of Public Prosecution of the Federation, Mr Rotimi Oyedepo, SAN, had announced his appearance for the AGF and informed that the court that the Attorney-General had taken over the prosecution from the ICPC, pursuant to Section 174 of the 1999 Constitution.
Oyedepo said the decision was guided by public interest and the need to ensure effectiveness, diligence, fairness and strict compliance with due process, assuring the court that the defendant’s rights would be fully protected.
Counsel for the ICPC, Dr Osuebeni Akpos, did not oppose the takeover, pledging the commission’s cooperation.
even as the former Attorney-General of the Federation and Minister of Justice, Kanu Agabi, SAN, led 15 other Senior Advocates of Nigeria as defence counsel.
Justice Peter Kekemeke later adjourned the case till February 24 for arraignment.
