Born November 16, 1958, in Gusau Local Government Area of Zamfara State, at 67, the de@th or survival of Nigeria's fragile and nascent democracy lies in the hands of the distinguished Honorable Justice Mohammed Lawal Garba, and four other eminent Justices of the Supreme Court, today.

WHY?

The Justice Mohammed Garba-led five-member panel of the Supreme Court has fixed today (April 22, 2026) for the hearing of an appeal filed by Senator David Mark, national chairman of the African Democratic Congress (ADC), against a suit filed by one Nafiu Bala who is being sponsored by the Bola Tinubu led APC regime to destabilize the main opposition ADC ahead of the all-important Nigeria's presidential election billed for January 16, 2027.

In the appeal marked SC/CV/180/2026, the Senator David Mark-led ADC leadership is seeking an order staying the execution of the Court of Appeal’s March 12, 2026 ruling, where all parties were asked to maintain status quo ante bellum, a legal lingo that has been a source of controversy within Nigeria's political firmament.

It must be recalled that the Senator David Mark-led ADC leadership had appealed a September 4, 2025, ruling by Justice Emeka Nwite of the Federal High Court, Abuja Division, that refused to grant some injunctive reliefs contained in an ex parte application filed by Nafiu Bala Gombe, asking the plaintiff to put all respondents on notice to show cause why his (Gombe's) ex parte motion must not be granted.

As the Justice Mohammed Garba-led five-member panel of Supreme Court sit today, we remind them that in a similar suit marked: FHC/ABJ/CS/1331/2025, filed by former presidential candidate of the ADC, Dumebi Kachikwu, the Courts of the land, via two Honorable Justices of the Federal High Court, Justice James Omotosho and Justice Joyce Abdulmalik had dismissed the suit citing Section 83(5) of the Electoral Act 2026, among other Supreme Court rulings showing precedence.

Section 83(5) of the Electoral Act 2026 states: "No court in Nigeria shall entertain jurisdiction over any suit or matter pertaining to the internal affairs of a political party."

It is against this backdrop that we are calling on Justice Mohammed Lawal Garba and his colleagues to pen their names in gold, and for posterity sake, summarily dismiss the suit filed by the usurper Nafiu Bala Gombe for lack of jurisdiction.

We are unequivocally, emphatically, and graciously calling on the Justice Mohammed Garba-led five-member Supreme Court panel to today, save Nigeria's fragile and nascent democracy from collapsing under the nose of the Bola Ahmed Tinubu led APC regime.
