Already, the EACC  investigators have freed the former High Court judge and three other suspects hours after their arrest for allegedly soliciting a KSh 10.4 million bribe to influence an active case before the High Court.
Justice Mutava, reportedly attempted to influence the outcome of a commercial dispute involving a former Cabinet minister.
He was arrested on Monday, March 10, alongside an advocate of the High Court, Kimani Wachira, and two other suspects.
"Following increasing media inquiries, the Ethics and Anti-Corruption Commission (EACC) confirms that today, Monday, 9 March 2026, the Commission arrested Hon. Joseph Mutava, a former judge of the High Court of Kenya; Kimani Wachira, an advocate of the High Court; and two other suspects. 
"The arrests relate to ongoing investigations where the suspects allegedly demanded an USD 80,000 (KSh 10.4 million) bribe to influence the outcome of a commercial dispute involving a former Cabinet minister, currently pending before the High Court," the anti-graft commission confirmed.
The suspects were detained at the EACC Integrity Centre Police Station pending processing.
The commission will send its investigation results to the Director of Public Prosecutions, DPP, for review and potential charges.
Meanwhile, Mutava was removed from office in 2016 following findings of gross misconduct and corruption, which were later upheld by the Supreme Court.
A tribunal chaired by David Maraga established that he improperly handled cases, including a dispute involving businessman Kamlesh Pattni.
To bolster the rule of law and public trust, EACC has recently intensified investigations into corruption within the justice sector, cautioning that bribery undermines court processes.
