In a landmark decision, the Court of Appeal has upheld the cancellation of Simon Atigwe’s victory, the Peoples Democratic Party (PDP) Member of Parliament for the Igbo-Eze North/Udenu Federal Constituency. The court confirmed that Hon. Dennis Nnamdi Agbo of the Labor Party (LP) rightfully won the February 3, 2024 election, overturning the previous declaration by the Electoral Petitions Tribunal.

The ruling, delivered by a panel of three judges led by Justice J.O Ekanem, affirmed Agbo’s victory in the highly contested race. The Labor Party’s lawyer, Ifeanyi Ogenyi, praised the judgment, stating in a press release on Wednesday: “Congratulations to the people of Igbo-Eze North/Udenu Federal Constituency. The wheels of justice turn slowly, but sharply. No matter what the wait, honesty and justice prevail. Dennis Agbo wins!”

This decision marks the conclusion of a long legal battle. Earlier, the Independent National Electoral Commission (INEC) had declared Simon Atigwe the winner of the election. However, Dennis Agbo, who had been disqualified before the February 25, 2023 elections by the High Court, challenged the ruling. After a series of appeals, Agbo emerged victorious.

This Court of Appeal ruling reinstates Dennis Agbo as the duly elected representative for Igbo-Eze North/Udenu Federal Constituency.
