Enugu Govt Clarifies Position on Industrial Gas Emission Levy

The Enugu State Government has clarified its stance on the industrial emissions tax introduced by the Ministry of Environment and Climate Change, stating that the implementation of the tax was suspended on August 29, 2024. The government also emphasized that discussions on the matter are ongoing. This clarification was made on Wednesday in a statement signed by the Secretary to the State Government (SSG), Prof. Chidiebere Onyia.

Governor Peter Mbah ordered the suspension and refund of taxes, asserting that the consultants hired by the Ministry of Environment and Climate Change exceeded their mandate. Onyia criticized misleading media reports that suggested the government was imposing fines for using renewable energy sources such as solar power, stressing that the state’s policies are focused on promoting renewable energy and environmental sustainability.

The statement further explained that, under Section 4(2) and Section 124 of the Enugu State Environment and Climate Protection Act of 2024, the ministry has the authority to enforce environmental laws, but the program for such implementation is still in development. Governor Mbah ordered the immediate cessation of the tax collection and the refund of taxes already collected.

Onyia noted that while the Enugu State Climate and Environmental Protection Act grants the ministry the power to regulate toxic emissions, the necessary programs for its implementation have yet to be finalized. The statement reassured that the government is in the process of developing a comprehensive climate policy to balance industrial growth with environmental sustainability.

Governor Mbah’s administration reaffirmed its commitment to environmental protection and tackling pollution, while ensuring that governance is conducted in a fair and transparent manner.
